HighPoints Terms of Service
These terms are the agreement between you and Happihack Studios ("we") for using the HighPoints app and service. By creating an account you agree to them. They are short on purpose; the privacy policy is a separate document.
1. What HighPoints is, and is not
HighPoints is a place to share, find, and rate outdoor spots that other people posted. It is an honor system. We do not verify that a spot exists, that it is safe, that it is legal to be there, or that anyone who rated it has been there. We do not tell you where you may or may not do anything.
2. You are responsible for where you go and what you do
Spots are posted by users, not by us. Before you go, check for yourself: land ownership and access rules, hazards, weather, and the laws that apply to you where you are, including laws about cannabis, which differ by state and are different again on federal land such as national forests and national parks. You go at your own risk. Leave places as you found them.
3. Your account
You must be 18 or older. One account per person. Keep your sign-in to yourself; you are responsible for what happens under your account. You can delete your account at any time from Profile, and that deletion is immediate and permanent.
4. What you post
You keep ownership of what you post. You give us a worldwide, royalty-free licence to store, copy, process, and show it to the people you chose to share it with, for as long as it is on the service, so that HighPoints can work. You promise that you have the right to post it and that it does not break section 5.
Photos and videos are stripped of embedded location data before storage. A spot's location is what you placed on the map, shared at the precision you chose. If you later change a public spot from exact to fuzzed, people who already loaded the exact pin may still have it.
5. What you may not post or do
- Locations you do not have the right to share, including private property without permission, and anything that identifies where a specific person lives.
- Content that is illegal, sexual, violent, hateful, or harassing, or that targets a person.
- Anything that facilitates the sale or delivery of cannabis or any other controlled substance. HighPoints does not list products, sellers, or prices, and never will.
- Fake spots, fake ratings, rating your own spot through another account, or automated posting.
- Impersonating someone, or using another person's account.
- Interfering with the service, probing it, or trying to recover a location someone chose to fuzz.
6. Reports and removal
Anyone can report a spot, a rating, or a person from inside the app. A person at Happihack Studios reads every report. We may remove content, restrict features, or close accounts that break these terms, with or without notice, and we may do so on a single report when the content is clearly out of bounds. If you believe something of yours was removed in error, email support@highpoints.io.
7. Blocking
You can block anyone. A blocked person is not told, cannot see your spots or ratings, and cannot find or contact you through HighPoints. Blocking is mutual in effect.
8. The service
HighPoints is provided as is. We may change it, add or remove features, or stop offering it. We will try to give notice of anything that affects your data. There is no fee for HighPoints today; if paid features are added, they will be optional and clearly marked, and these terms will be updated first.
9. No warranty and limits on liability
To the fullest extent the law allows: HighPoints is provided without warranties of any kind. We are not liable for what happens at a spot, for the accuracy of anything a user posted, or for any indirect, incidental, or consequential loss. Our total liability to you for any claim is limited to USD 100 or the amount you paid us in the past twelve months, whichever is greater. Some places do not allow these limits; where that is the case they apply as far as they can.
10. Ending this agreement
You can end it by deleting your account. We can end it by closing your account for breaking these terms. Sections 4, 9, 11, and 12 survive.
11. Governing law
These terms are governed by the laws of Oregon, United States, without regard to conflict of law rules. Any dispute will be brought in the courts of Clackamas County, Oregon.
12. Changes
We may update these terms. If a change matters, the app will tell you before it takes effect, and continuing to use HighPoints after that means you accept it. The date at the top is the current version.
